2012 Polish Constitutional Tribunal on a day off

Polish Constitutional Tribunal ruled that the provision on the basis of which an extra day off in lieu for Public Holiday falling on a day off from work was taken away is inconsistent with the Polish Constitution.

The Tribunal ruled the provision which deprives an additional day off for a day off falling on a Public Holiday is inconsistent with the constitutional principle of equality. Obligation to return such a day to workers was abrogated after introduction in  2011 a day off on Trzech Króli Holiday (6 January).

Tribunal have not specified any transition period, the judgment is final, which means that the provision in question expires upon publication of the judgment in the Journal of Laws.

Judgment means returning to the principles prior to the amendment introducing a day off on Trzech Króli Holiday - for each Public Holiday that falls on a day off - except Sunday - employees receive an extra day off from work
