Resolution dated on 7 th October 2008 (reference symbol of files III CZP 95/08).
A person who accepts to purchase the property in accordance with the price stipulated in a notice (article 29 of resolution 1d read with article 29 of resolution 1c of resolution dated on 19 th October 1991 - Act on the Administration of the State Treasury Agricultural Property, uniform text Journal of Law dated on 2007, Nr 231, pos. 1700) and therefore exercises the right of priority - regulated in article 29, resolution 1, subparagraph of above-mentioned resolution - is not entitled to a claim for concluding a contract.

Regulation of art. 241 § 2, second sentence of Labor Code do not exclude a rule of specifying reasons for termination work relationship (article 45 § 1 read with article 42 § 1 of Labor code) or consulting such a termination with trade union (article 38 of Labor code) if the terminated collective labor agreement for the company has not been replaced by new one or by remuneration regulation.

Lost of right of free shares acquisition by the entitled (article 38 of resolution 1 dated on 30 th August 1996 about commercialization and privatization, uniform text Journal of Law dated on 2002 Nr 171, pos. 1397 with all the changes) due to the infringement by the State Treasury the obligation of appointing entitled employees results (on the basis of article 471 read with article 361 of Civil Code) in liability of State Treasury for loss of dividend due to non-passing the shares if the entitled proves the fact of being the owner of the shares on the dividend day (article 348 § 2 of the Commercial Code of Companies)
